COMPLIANCE WITH THE FREELANCE ACT
ADK Holdings Inc. and its subsidiaries — ADK Marketing Solutions Inc., ADK Creative One Inc., and ADK Emotions Inc. (hereinafter collectively referred to as the “ADK Group”) — shall comply with the “Act on Ensuring Proper Transactions Involving Specified Entrusted Business Operators” (hereinafter referred to as the “Freelance Act”) in all transactions with freelancers (*).
*The term “Freelancer” refers to any of the following:
(1) An individual that does not employ any employees.
(2) A corporation that has no officers other than a single representative and does not employ any employees.
To ensure compliance with the Freelance Act, the ADK Group provides the following guidelines to all freelancers conducting business with us. We kindly ask for your cooperation in reviewing and adhering to these items.
1. Contact for Harassment Consultations
(Sexual Harassment, Maternity Harassment, and Power Harassment)
If any instances of harassment or suspected harassment (whether committed/ attempted) by officers or employees of the ADK Group are discovered in connection with business transactions, we kindly ask that all freelancers contact the consultation desk listed below.
For reporting any misconduct by ADK Group officers or employees other than harassment, please refer to our separate Whistleblowing System for Business Partners.

(2) Precautions Regarding Consultations
- When raising a concern, please clearly state the name and contact information (hereinafter “Information of Person Raising a Concern”). However, a concern is also able to be raised without disclosing any Information of Person Raising a Concern to the consultation desk. In such cases, the contact means will be determined through discussion between the person in charge at the desk and the person raising a concern.
- When raising a concern, please attach materials that serve as grounds or evidence for the facts related to the consultation, to the extent possible
- Please note that a consultation may not be accepted as a valid compliant in cases where investigation is difficult (e.g., the content uses codes, hints, or riddles that are difficult to understand and the person raising a concern cannot be reached), where the matter has already been resolved, where facts cannot be verified due to lack of cooperation from the person raising a concern, or where the content is clearly false or clearly does not constitute harassment.
- Personal information of the person raising a concern will be handled strictly in accordance with the “Act on the Protection of Personal Information” and our Privacy Policy.
(3) Protection of Persons Raising Concerns (Prohibition of Disadvantageous Treatment)
- The ADK Group will not subject any person raising a concern to disadvantageous treatment solely on the grounds of having sought a consultation regarding harassment, having cooperated in the verification of facts, or having requested appropriate measures from a Labor Bureau or other relevant authorities.
- Any persons who become privy to information regarding a consultation in the course of their duties, such as person in charge of the consultation desk and members of the Investigating Organization shall maintain the confidentiality of such information and must not disclose it to third parties without the consent of the person raising a concern or other justifiable reasons.
2. Contact for Consultations Regarding Balancing Work with Childcare, Caregiving, etc.
If any concerns for balancing work with pregnancy, childbirth, childcare, or caregiving while conducting business with the ADK Group, please contact the person in charge at ADK Group assigned to each relevant transaction.
The ADK Group will not subject any consultant to disadvantageous treatment solely on the grounds of having requested consideration for childcare, nursing care, etc., or having received such consideration.
3. Request for Notification of “Freelancer” Status
To ensure full compliance with the Freelance Act in our transactions, the ADK Group seeks to accurately identify whether the Act applies to each of our business partners.
Accordingly, if any of our business partners are classified as “Freelancer” and have not yet notified us of this status, we kindly ask them to contact us at the address below. The same applies to cases where they were not classified as a “Freelancer” at the start of our business relationship but have since become one. Note: This does not apply if a business partner is already registered in our system as a sole proprietor (under an individual name) when registering trading account with the ADK Group.
